Heidi has represented unions and individuals in a variety of administrative proceedings, including collective bargaining agreement disputes, grievances, and unfair labor practice (ULP) charges.
On behalf of the police union and working hand-in-hand with the firefighters’ union, she brought a ULP to successfully challenge an employer’s unilateral decision to discontinue counting sick leave as hours worked for overtime. The employer disagreed with the unions’ assertion that the issue was negotiable. The unions successfully prosecuted the ULP, and the panel’s decision was upheld by the Arlington County Circuit Court and the Supreme Court of Virginia.
Heidi also has experience with grievances and arbitration proceedings to enforce collective bargaining agreement provisions. As one example, she successfully argued that the employer’s unilateral decision to change the police department’s performance evaluation system violated the parties’ collective bargaining agreement. As another example, she obtained an arbitration award requiring the employer to provide secure parking for the officers consistent with the employer’s obligations in the CBA.
Additionally, Heidi routinely represents employees in disciplinary proceedings and grievances. She has successfully overturned terminations and other forms of discipline and has fought to vindicate employees in the face of policy violations by the employer. She also counsels individuals about decertification proceedings before the Virginia Department of Criminal Justice Services.
